Can a Motability Lease Be Managed Under Power of Attorney?
The Quick Answer: Holding power of attorney does not automatically give you control of a Motability lease. A property and financial affairs Lasting Power of Attorney (LPA) in England and Wales may allow you to act, but its wording and restrictions matter, and Motability Operations decides what authority it accepts. An appointee's role is limited to benefits, and being a named driver gives no power to sign or change the agreement. Ask Motability what evidence it needs before you sign, renew or cancel anything.
Managing a relative's lease under a Motability power of attorney means more than accessing their paperwork. Two things need checking: what the document allows, and what the Motability Scheme and Motability Operations accept. Holding power of attorney does not automatically give you control of the lease.
Financial authority may help you act, but confirm the arrangements before signing anything or changing the lease. Keep legal representation, benefits management and permission to use the vehicle separate.
Motability power of attorney: what needs checking
Financial authority and mental capacity
In England and Wales, a registered property and financial affairs Lasting Power of Attorney (LPA) can authorise financial decisions. The wording and restrictions in the LPA define what the attorney can do. It doesn't automatically give you control of a Motability lease, though.
A health and welfare LPA doesn't give the same financial powers. Legal arrangements differ in Scotland and Northern Ireland.

An appointee has a different role
An appointee is not the same as a power of attorney. An appointee from the Department for Work and Pensions (DWP) manages benefits for someone who can't manage their own affairs. GOV.UK's appointee guidance explains how that appointment works.
Eligibility for the Motability Scheme depends on a qualifying mobility award, not simply on receiving disability benefits. This can include the enhanced rate mobility component of Personal Independence Payment. It can also include the higher rate mobility component of Disability Living Allowance, but not Attendance Allowance. Attendance Allowance can be managed by an appointee, but it doesn't provide a qualifying mobility award for the Scheme. Reaching state pension age can change which benefits are available, so check the current Scheme rules before acting.
However, that role isn't the same as a power of attorney. It doesn't automatically establish authority over every contract.
Similarly, being a relative, carer or one of the named drivers doesn't give you financial authority. Before you request a renewal, cancellation or equipment change, ask Motability what evidence and authority it requires for that specific action. Keep the customer's wishes central whenever they can make the decision themselves.

Getting your authority recorded with Motability
Prepare before you call so you can explain your role accurately and avoid delays.
- Have the customer's details, agreement reference and authority document ready.
- Ask Motability Operations how it records authority on the lease and how to submit evidence securely. Check what evidence it accepts, whether identity checks apply, and if additional consent is needed.
- Confirm which account actions are permitted under your authority before changing the lease agreement. This covers discussing the account, signing documents and arranging changes. Permission to operate equipment or drive the vehicle is separate from financial authority. Financial authority is separate from being one of the named drivers. Being one of the named drivers doesn't give you authority to sign or alter the agreement. Keep those roles separate when recording your authority.
If you are an appointee, explain that your authority is limited to benefits and doesn't cover the agreement.
Ask Motability to explain any limits and keep its response with the lease paperwork. An avoidable mistake is assuming that permission to discuss servicing also permits changing the agreement.
If the customer still has capacity, involve them directly. If capacity has already been lost without suitable authority, seek advice about the appropriate legal route.

Legal authority and product suitability need separate attention. The Motability Scheme offers mobility scooters and powered wheelchairs, but the choice should reflect the customer's daily needs.
Make the assessment practical

During a practical assessment, check doorway clearance, seating, adaptations and access to charging. Then test each mobility component, including the controls, on the routes the customer actually uses. Real customer experiences and lifestyle images can help, but their own test-drive experience is more useful than choosing by appearance alone.

Local assessments and servicing support

If the Motability customer dies
Following a bereavement, a power of attorney ends when the person dies. An appointee’s authority also ends on death. The family or estate representative should contact Motability Operations. They will confirm the steps and deadlines for that specific lease, including the return window.
You may need the death certificate when contacting them. Keep it ready, as the Scheme may ask for it. If probate is required, ask what Motability Operations needs from you. A second copy of the death certificate can help with estate matters.
Also ask whether Tell Us Once should wait until probate is confirmed. Do not use Tell Us Once before that point. Ask how Tell Us Once interacts with the estate. Confirm with Motability how Tell Us Once should be timed.
Contact Motability on 0300 456 4566 before using Tell Us Once. Do not use Tell Us Once until the correct steps are confirmed. Tell Us Once can notify several government departments. However, notifying the DVLA first can affect vehicle tax. Only notify the DVLA after Motability Operations confirms. Ask how vehicle tax is affected and what to tell the DVLA. Motability Operations must confirm the applicable steps, deadlines and permitted use for the lease.
Ask how Tell Us Once affects the DVLA. Use Tell Us Once only after those steps are agreed. If Tell Us Once notifies the DVLA too early, problems can follow. Check with Motability before you use Tell Us Once for the DVLA. Tell Us Once should not replace the steps Motability confirms.
For cars, Motability may allow continued use for a limited period after notification. Confirm the return window and any permitted use. The return window may be short, so do not delay. Being a named driver doesn’t automatically authorise use after the customer’s death. Named drivers must wait for Motability to confirm what is allowed. Ask whether named drivers can use the car during the return window. Named drivers should not assume permission continues.
Scooters and powerchairs have different arrangements. Ask Motability about collection, insurance, fair wear and tear, Good Condition Payment, and whether any advance payment or other amount is due under that lease. Ask whether an advance payment is refundable before collection.

Then focus on equipment, including adaptations and wheelchair accessible vehicles, that the customer can use comfortably and safely. Clear paperwork and a practical assessment, perhaps with a dealership or the scheme, help families support the customer without overlooking legal or insurance limits. They also encourage sound decision making for the arrangement. Check who is one of the named drivers.
Confirm how tax treatment applies to payments, and review it again if the arrangement changes. Check whether state pension age affects the customer's position, and revisit the rules if benefits change. If the customer moves to Attendance Allowance, the mobility rules may change. Ask about the advance payment, the return window, and the Good Condition Payment before you sign. Confirm the return window and any advance payment details in writing. Fair wear and tear may affect that too.
